Terms of Sale

Please note the following for the sale for all SMRU telemetry devices:

SMRU warrants these products to be free from defects in material and workmanship at the time of delivery and for up to two months following delivery. If a defect should occur or become apparent then please contact SMRU as soon as possible. If found to be defective, the product will be replaced or repaired.

Please note the following specific exclusions to this warranty:

  • the batteries
  • the instrument after it is deemed to have been deployed
  • damage to any equipment resulting from misuse, accidents, unauthorized service, extreme conditions, or other causes
  • any further warranties or conditions, expressed or implied, including warranties of merchantability, quality or fitness for a particular reason or those arising by laws, statutes or trade usage or course of dealing.

It is not normal practice for SMRU to replace spent batteries due to the conditions of carriage restrictions associated with the shipping of lithium cells. Any damage or liability resulting from the replacement of batteries, whether to the tag or any third party, shall be the responsibility of the purchaser.

Any additional costs incurred through satellite charges or phone charges shall be the responsibility of the purchaser. In the case of ARGOS charges, the purchaser shall normally provide active PTT numbers in the required format. Costs for SMS messages, phone calls and SIM rental shall be the responsibility of the purchaser from the date of despatch from SMRU. The purchaser shall be invoiced on a quarterly basis until the SIMs are cancelled. SIM cancellation shall be by SMRU with mutual agreement of the purchaser.

SMRU neither accepts the responsibility for loss or damage during transportation nor for delays resulting from shipment on commercial or private carriers. The entire risk as to the results and performance of the product is assumed by the purchaser.

Neither SMRU, the University of St Andrews nor its suppliers, shall have any liability to the purchaser or any other person or entity for any indirect, incidental, special, or consequential damage whatsoever, regardless whether SMRU has been informed of the possibility of such damages or that such damages might be foreseeable.

Neither SMRU nor the University of St Andrews accept any responsibility or liability for the claims of any third party.
